Mediation and arbitration support

Go into mediation prepared, with someone on your side.

Mediation is a confidential meeting where an independent mediator helps you and your franchisor reach an agreement. Arbitration is a private process where an independent arbitrator decides the dispute. We prepare you for both and support you through them.

Our independence

We act for franchisees only. We never act as the mediator or arbitrator in a dispute, and we never act for the franchisor. The mediator or arbitrator is always an independent third party agreed between you and your franchisor.

Mediation and arbitration explained

  • Mediation: voluntary and confidential. The mediator does not decide who is right; they help both sides find a deal. Nothing is binding until a settlement is signed.
  • Arbitration: a private alternative to court. An arbitrator hears both sides and makes a decision, called an award, which is normally binding.
  • Many franchise agreements require mediation or arbitration before court. We check what yours says.

How we support you

  • Check whether your franchise agreement requires mediation or arbitration, and on what terms
  • Help you and your franchisor agree an independent mediator or arbitrator
  • Prepare your case summary and documents
  • Plan your objectives, your offers and your walk-away point
  • Attend with you and represent you where permitted
  • Make sure any settlement terms are clear before you sign, and recommend a solicitor's review where needed

Questions and answers

Can you be the mediator for both of us?

No. Because we act for franchisees, we cannot also be neutral. We will help you and your franchisor find an independent mediator.

Who pays the mediator?

Usually the two sides share the mediator's fee, but this is agreed in advance. Your franchise agreement may also say how costs are dealt with.
